General

For the business relations between HALLOWEEN GmbH and the orderer, solely the following terms of business are valid in whatever version was displayed on the internet at the time of the order. Special conditions are only valid with written confirmation of HALLOWEEN GmbH. HALLOWEEN GmbH reserves the right to replace ordered items with equivalent ones. In some cases, this may cause (slight) variations of form or colour compared to the photos displayed on the website.

The orderer confirms that he/she is at least 18 years of age or acts with commission and consent of a legal guardian. All items offered are not suitable for children under 3 years of age. Even items that include an age limit or use the word "children" in its description must only be used under supervision of a legal guardian. Legal guardians will be held responsible for their children. Please note the "manufacturers" directions for use of each item!

Contract and Withdrawal

HALLOWEEN GmbH commits to accept the order of the orderer under the conditions of the website. In case one of the suppliers should not supply HALLOWEEN GmbH with the ordered merchandise, in spite of contractual agreement with HALLOWEEN GmbH, HALLOWEEN GmbH may be entitled to withdrawal from the contract. In this case the orderer will be notified immediately that the ordered item is not available. Already paid amounts will be refunded immediately.

Right to revoke an offer/Return Policy

The orderer may revoke the contract through mail, e-mail or return of the items in its original packaging within two weeks (date of postmark).

This period of time starts with reception of the merchandise and this indoctrination. In order for a keeping of the term, it is sufficient to return the items in time.

Should the value of the ordered merchandise exceed 40 EUR, HALLOWEEN GmbH will reimburse the cost for the return; in all other cases, the orderer is responsible for return costs. Return of merchandise must be done in the least expensive way possible. We emphasize explicitly that HALLOWEEN GmbH can keep a depreciation that may have been caused by use of the item.

There exists no right to revoke the offer for CDs and DVDs whose seals have been broken by the orderer; also excluded from exchange are, for hygienic/sanitary reasons, make-up items, dental items etc.

We will only accept returned items in an unused condition. Please make sure you include your bank account information when returning merchandise. Insufficiently stamped or not at all stamped mailings cannot be accepted for organizational reasons.

There is no right to return special designs resp. special order items (these items are marked clearly).

Pricing / Shipping costs / delivery times

All prices are stated in Euro, legal taxes are included and will principally be noted on the bill.

Euro prices also apply to shipment to countries that do not belong to the Euro-zone, possibly noted prices in different currencies solely serve the purpose of simplifying displays and are neither legally binding nor part of the contract. The decisive factor is always the marked Euro price. In addition to noted individual prices, we also charge a flat rate for shipping costs, which, among other things, include packaging. You can also extract average shipping times from this table. All shipping times are marked as work days. Saturdays, Sundays and holidays are not work days in terms of shipping time. As a rule, we ship the day we receive the money, or one day later. Shipping times are solely estimated and not binding. Please note that with shipments to Switzerland, delays may occur due to the process at customs. Possible additional costs due to customs and custom processing lie at the expense of the buyer. Those living on an island, please expect an additional 2-3 days delivery time. We do not charge additional money for shipping to islands.

Delivery and Payment Conditions

Deliveries are sent out through our storehouses to the address given by the orderer. Specifications about delivery times are not binding. Claims to delayed deliveries are debarred even after an additional respite mentioned by the buyer.

The minimum order value is € 0,00.

The danger of accidental demise as well as accidental deterioration of sold items only becomes the responsibility of the buyer after the handover/delivery through the forwarding agency/parcel service. It makes no difference for the handover/delivery whether the buyer defaults acceptance.

Payment/Purchase price is due immediately with the order. Payment options for the order are, as of now, advance payment or credit card. In case of the advance payment option, all deliveries will occur through various parcel services or forwarding agencies after we have received the money at this account:

Possible costs of cash remittance are on behalf of the buyer. Usually, transfers within the EU are at the same cost as national remittances.

The orderer will receive an e-mail notification about order shipment.

All bills are due in full right away. From the beginning of default, the buyer owes the seller default interest in addition to the purchase price. The applicable interest rate is 5% higher than the basic interest rate of the European Central Bank.

Our delivery and payment conditions are binding and will be honoured when ordering.

Reservation of Proprietary Rights

Until full payment, delivered items are property of HALLOWEEN GmbH.

Privacy Policy

The orderer realizes and agrees that all personal data needed for order processing will be saved on data carriers. He/she explicitly agrees to collection, processing and usage of his/her personal data. The orderer has the right to revoke this adhesion at any time with effect on the future. HALLOWEEN GmbH is obliged to immediately erase all personal data in this case, unless order procedures have not been finalized. Transmission of personal data, such as credit card information, etc. takes place through secure server software (SSL-Protocol).

Passing on of data for credit examination purposes is automatically agreed to. Every customer agrees to being informed by us about important things.

Only those customers will receive detailed information who explicitly requested our newsletter. In order to avoid abuse with respect to orders, every orderer agrees to have his customer IP-address recorded.

Court of Jurisdiction and applicable rights

All contracts made with us are subject to German law with exclusion of UN purchase law; place of performance and court of jurisdiction for both parties is Wuppertal, Germany.

Special Regulations and additional agreements when delivering to companies

a.) Definition

Companies are natural persons or legal entities or legally responsible associations, which act in commercial or independent actions.

b.) Aberrant terms of business

aberrant, opposing or additional Terms of business will not, even with awareness, become part of the contract, unless their application has been agreed to in writing.

c.) Reservation of proprietary rights

The buying company has the right o re-sell the merchandise in orderly courses of business. It already now concedes all demands in the amount of the bill to HALLOWEEN GMBH, which may result from a re-sale to a third party.

d.) Passing of risk

The goods shall, from the time of supply by HALLOWEEN GMBH to the forwarding agent, be at the Buyer´s risk.

e.) Return Policy

The return of items, except in case of defects or lack of confirmed important qualities, is not applicable.

f.) Warranty

The warranty time limit is 1 year.

g.) Payment

Payments must be made in full at the latest 10 days after delivery. From the beginning of default, the buyer owes the seller default interest in addition to the purchase price. The applicable interest rate is 8% higher than the basic interest rate of the European Central Bank.

Severability Klausel

In case one of the aforementioned clauses becomes ineffective, the validity of all other clauses remains untouched. The parties are obliged to agree upon a new clause in place of the affected ineffective clause, which serves a purpose closest to the desired one.
